Nonprofit Organization Promotion
Terms of Agreement

We maintain this promotion as a service to the general community by helping Nonprofit organizations. We require that you read and agree to all terms.
  1. Definitions as to Parties. It is understood there are two parties in regards to this agreement. The organization (“Organization”) is defined by the name of the organization named in the application, located at the address defined in the application. The company (“Company”) is defined as being EnterNet NOW, Inc. located at 751 Lonesome Dove Lane, Copper Canyon, Texas 75077-4829.

  2. Acceptance of Agreement. You agree to the terms and conditions outlined in this Terms of Agreement (“Agreement”) with respect to our Nonprofit Organization Promotion (the “Promotion”). This Agreement constitutes the entire and only agreement between the Company and the Organization, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Nonprofit Organization Promotion, the content, products or services provided by or through the Promotion, and the subject matter of this Agreement. This Agreement may be amended at any time by the Company without specific notice to the Organization. The latest Agreement will be mailed to you within 30 days of the new effective date of the agreement.

  3. Agreement of Acceptance. The Organization must agree to the Nonprofit Organization Promotion Qualifying guidelines. When a representative of the Organization and a representative of the Company place a signature on the Application, this agreement is considered to be binding by both parties.

  4. Organization Responsibilities. The Organization will:
    1. Spend all monies received from the Company on acceptable morale and ethical activities.
    2. Remain in active acceptance of the Nonprofit Organization Promotion guidelines.
    3. Encourage their members to sign up with this promotion.

  5. Company Responsibilities. The Company will:
    1. Maintain $10.00 for every new customer of the Company that designates the Organization’s promotion code.
    2. Maintain $0.40 for every active and paid month of each customer that has designated the Organization’s promotion code.
    3. Maintain commissions from any other documented promotion for all our other products or services for each customer that has designated the Organization’s promotional code.
    4. Direct the creation of reports itemizing the monies mentioned in item B, C and D of this section on a semi-annual basis.
    5. Direct totaling of all monies mentioned in items B, C and D of this section on a semi-annual basis.
    6. Direct the delivery of the reports and a check, made out to the Organization, for all monies totaled in items E and F in this section to the Organization.
    7. EnterNet NOW, Inc. continues to search for ways to help nonprofit organizations, such as our shopping links. We will let you know of other ways to earn contributions for your Nonprofit Organization as they are introduced.

  6. Semi-Annual Definition. The definition of Semi-Annual will be the closing of the books for the period on January 1 and July 1 of each year. The definition for Semi-Annual delivery of reports and checks will be thirty (30) days after the closing of the books for the period.

  7. Term of this Agreement. The term of this agreement will begin on the signature date that is entered on the application. The period of duration or term of this agreement is perpetual.

  8. Cancellation of this Agreement. Either party may cancel this agreement at any time with thirty (30) days notice, in writing. If the Organization wishes to cancel, they must notify the Company with thirty (30) days notice with certified mail to EnterNet NOW, Inc., 751 Lonesome Dove Lane, Copper Canyon, Texas 75077-4829. If the Company wishes to cancel, they must notify the Organization with thirty (30) days notice with certified mail to the Organization at their specified address on this application.

  9. Customer Notice of Cancellation. It is up to the Organization to notify their members of the cancellation of this agreement. The Customer must direct a new designation, cancel their agreement with the Company, or we will redirect all funds for the Organization’s promotion code to a new Organization of EnterNet NOW, Inc.’s choice.

  10. Governing Law. This Agreement will be governed by the laws of the State of Texas without reference to conflict of law principles. All disputes arising out of or relating to this Agreement will be subject to the exclusive jurisdiction and venue of the state courts sitting in Denton, Texas, and the federal courts in the US District of Texas, and each party irrevocably consents to such exclusive jurisdiction and venue and waives any objection thereto.

  11. Entire Agreement. This Agreement, together with the Exhibits attached hereto, constitutes the entire understanding and agreement between Organization and Company with respect to the transactions contemplated, and supersedes any and all prior or contemporaneous oral or written representation, understanding, agreement or communication between Organization and Company concerning the subject matter hereof. Neither party is relying upon any warranties, representations, assurances or inducements not expressly set forth.
